1. No Guarantees
Clients receiving coaching and mentoring support and guidance, are not guaranteed results from participating in coaching programs. Clients acknowledge that no one has guaranteed personal, health, fitness, financial, or other results from purchasing any of the services form Your Red Dress. Clients understand that what the Coach/Mentor is providing is only one of many parts of a successful outcome.
2. Entire Agreement
This Agreement, the Company Policies and Disclaimers, and the Credit Card Authorisation are the entire agreements between coach and client. These written documents supersede any prior discussions, emails, online or voice messages.
3. Ownership of Written Materials
Clients will have one license to view written materials provided by Your Red Dress. Clients do not have ownership of this information, which is protected by copyright laws. Some of the information is also protected by a contractual license between the provider and the company. Clients may not copy, re-engineer, distribute, or otherwise provide access to this information to any other person, for free or paid, without express written consent of the Company, which it may withhold for any reason, and purchase of a license.
4. Confidentiality
All information shared between clients and the coach during coaching sessions will be treated as confidential. The Coach/Client ’will ensure that they keep any records of discussions saved confidentiality and privately and they will not disclose any information to another party.
Please respect the privacy of all participants of any Group Coaching programs, however the Coach/Mentor cannot guarantee confidentiality among the participants. Clients should not not share any confidential and proprietary information which may harm their business, personal or career interests if repeated, copied, or otherwise transmitted and/or implemented by a third party.
THESE ARE THE CLIENTS’ RESPONSIBILITIES
5. Know Your Own Circumstances
You are in the best position to evaluate your personal circumstances, including legal, medical, financial, business, and family matters, and you take sole responsibility for the decisions or actions (or inaction) regarding them as those decisions or actions pertain to participation in the program. For that reason, you are personally responsible for all research, preparations, labour, and/or business decisions made as a result of or arising from participation in this program. You shall make all such evaluations and decisions independently.
6. No Professional Advice
The Coach/Mentor does not engage in the rendering of legal, accounting, or other professional services. Additionally, the Company does not represent itself as acting in the position of an investment advisor or investment manager for the use of the information in the Program. Any information provided during the Term of this Agreement is not meant to be an endorsement or offering of any business or other investment. You acknowledge that you will make your own decisions before acting on any information gained from this program. It is further understood that before you utilise any techniques suggested by this program, you should consult professional legal counsel and/or competent financial advisor.
7. No Guarantee of Results
Your success will be largely dependent upon individual decisions, abilities, and general market forces, and the Coach/Mentor makes no guarantees or warranties that information provided to you through the program will result in profits. To the extent that the Coach/Mentor discusses its own past experiences, such discussions are intended for demonstration purposes only and are not a recommendation for you to conduct your business or decision-making process in a similar fashion. Further, such discussions are in no way an endorsement or recommendation that similar investing techniques will result in your success.
The Coach/Mentor is in no way responsible or liable for your use of the information provided through the program in building a business utilising the principles discussed in the program. The risk of loss in business can be substantial. By signing this Agreement, you acknowledge that you assume all risks and liabilities related to your business, including the loss of funds invested.
8. The Coach/Mentor can end participation in the program
The Coach/Mentor’ may determine, in its sole discretion and without requiring disclosure of the reason, that the relationship under this Agreement must terminate. In this circumstance, the Company will provide a monthly pro-rated refund to you.
9. No relationship.
The parties hereto expressly understand and agree that they are not employers or employees, principals and agents, or partners or co-venturers in the performance of each and every part of this Agreement, and they remain solely responsible for all of their respective employees and agents.
